Terms of Service

The agreement between you and Lottevo for the website, your workspace and the Data API.

Effective from Version 1

1. Who we are

Lottevo is operated by BLĂJAN ADRIAN-ȘTEFAN PERSOANĂ FIZICĂ AUTORIZATĂ (BLĂJAN ADRIAN-ȘTEFAN PFA), a sole trader registered with the Romanian Trade Register under number F2025049307002, tax identification number (CIF) 53035590, special VAT identification number RO55519049 (article 317 of the Romanian Fiscal Code, used only for services supplied to businesses in other EU member states), with its registered office at Str. Teilor 21E, Florești, Cluj, Romania ("Lottevo", "we", "us"). You can reach us at contact@lottevo.com.

These terms apply to lottevo.com, the workspace you reach after signing in, and the Data API at api.lottevo.com (together, the "Service"). By creating an account, or by using an API key, you agree to them. If you use the Service on behalf of a company, you confirm you are allowed to bind that company, and "you" means the company.

You are a consumer when you use the Service for purposes outside your trade, business, craft or profession. Where a section applies only to consumers or only to businesses, it says so.

2. Your account

  • You must be at least 18 years old, or the age of majority where you live if that is higher.
  • Keep the details in your profile and your billing details accurate and up to date.
  • You are responsible for everything done with your account and your API keys. Keep your password and keys secret, and revoke a key from your workspace as soon as you think it has been exposed.
  • One person or company holds one account. Opening further accounts to get around a plan's limits or to repeat the free trial is not allowed.

3. The Service, the trial and the plans

The Service gives you lottery data: the catalogue of games, draw schedules, results, prize breakdowns, payout tables, historical statistics and compliance information, delivered by request, by webhook or over a live stream.

Free trial. Each account can use the free trial once. It starts when you create your first plan key (not a sandbox key), lasts 14 days and needs no payment details. Its limits are shown on the pricing page. When it ends, your plan keys stop returning data until a paid plan is active.

Sandbox keys. Any account can create free sandbox keys for testing. They return only a small, delayed set of data, do not start the free trial and are not a plan; we may change or withdraw them at any time.

Paid plans. The paid plans, their prices, limits and features are published on the pricing page and shown in your workspace before you buy. What a key can do depends on its plan: the scopes it carries, the number of requests it may make per day and per minute, the lotteries it covers, the history it can read and the number of keys an account may hold. A plan with individual terms can also be agreed with us in writing; where that agreement differs from these terms, the agreement prevails.

We keep improving the Service and may add, change or remove features. If a change removes something your paid plan relies on, we will tell you in advance and, where the change is material, you may end the plan with a pro-rata refund of fees paid for the unused period.

4. What you may do with the data

While your account is in good standing, we grant you a non-exclusive, non-transferable licence to use the data you receive through the Service for any lawful purpose, commercial purposes included: in your own websites, applications and internal systems, and in the products and services you offer, where you may show it to your users.

Data you have already received. You may keep the data you received while your account had an active paid plan. Data received during the free trial or with sandbox keys may be used only to evaluate the Service. Delete trial data when the trial ends, and sandbox data when you finish evaluating the Service or close your account. Starting a paid plan does not change this: to use such data commercially or keep it after your paid plan ends, receive it again through your paid plan. After your paid plan ends or your account is closed, you may go on storing the data received under your paid plan, keeping backups and using it, together with the statistics and content you derived from it, under this section and without further fees; the restrictions in this section, including the ban on resale and our database right, continue to apply to it. While your plan is active, you may store everything you receive, including results that later fall outside your plan's history window. This does not cover data obtained in breach of these terms, and the licence for data already received ends if we close your account for a serious breach (section 9). After your plan ends, we have no obligation to provide further updates, corrections or support for retained data, except as expressly agreed in writing or required by applicable law. This does not affect obligations accrued before the plan ended.

No resale. You may pass the data between the parts of your own product, for example from your server to your website or app, and let the developers, hosting and other service providers who work for you handle it to build and run that product. Unless a written agreement with us expressly allows it, you may not sell, resell, redistribute, sublicense or otherwise offer the data to others as data in its own right, for example as a data feed, a data API, an export or a dataset. To agree on such use, write to contact@lottevo.com.

The database. Lottevo has made a substantial investment in obtaining, verifying and presenting the contents of the Service (the catalogue of games, the draw history, prizes, statistics and data quality information) and is the maker of this database. We reserve the sui generis right in it under Directive 96/9/EC (article 7) and Romanian Law no. 8/1996 on copyright and related rights (title II, chapter VII, articles 140 to 143). The result of a draw, taken on its own, is a public fact; our right covers the collection as a whole, not the numbers drawn.

The licence above covers what your plan includes: the plan's lotteries, history and request allowance. Beyond that, unless a written agreement expressly allows it, you may not extract or re-use a substantial part of the contents of the database, evaluated qualitatively or quantitatively, by any route: the website, the workspace, the API, widgets, the MCP server or the SDKs. Nor may you repeatedly and systematically extract or re-use insubstantial parts of it where this conflicts with a normal exploitation of the database or unreasonably prejudices our legitimate interests. Systematically working through the Service to rebuild the database or its history beyond what your plan includes is a serious breach of these terms within the meaning of section 9. Nothing in this section restricts the uses of insubstantial parts that the law allows a lawful user (article 142 of Law no. 8/1996).

You may not:

  • systematically work through the Service, with one or more keys or accounts, to copy the database or its history beyond what your plan includes;
  • share your API keys with third parties. Your employees, developers and service providers may use them only as necessary to build and operate your product on your behalf; you remain responsible for their use, and they may not use the keys or the data for their own purposes or for other customers;
  • bypass or try to bypass rate limits, quotas, scopes, origin checks or lottery entitlements;
  • scrape the website or the workspace;
  • probe, overload or disrupt the Service, or use it to break any law.

5. Accuracy of the data

We check results and other data carefully before publishing them, but they are provided for information only. The lottery operator remains the official source: before acting on a result, such as paying out a prize, confirm it with the operator.

Statistics describe past draws. They are not a prediction of future results and must not be presented to your users as one.

No warranty. To the extent the law allows, the Service and the data are provided without any warranty of any kind, express or implied, including warranties of accuracy, title, non-infringement of the rights of third parties, merchantability or fitness for a particular purpose. We do not warrant that the data, or your use of it, is free of the rights or claims of third parties. This does not affect the legal guarantee of conformity consumers have under mandatory law.

Lottevo is not a lottery operator, does not sell tickets and is not affiliated with, endorsed by or partnered with any lottery operator. Lottery names and logos belong to their respective owners and appear only to identify the games. Compliance information (age limits, permitted channels and similar) is a summary of what the operators publish; you remain responsible for complying with the gambling and advertising rules that apply to your own product and users.

6. Availability

We work to keep the Service available and fast, but we do not promise that it will be uninterrupted or error-free. Maintenance, the availability of our data sources and events outside our control can delay or interrupt data. Unless a service level is agreed with you in writing, the Service is provided "as is" and "as available".

7. Prices, payment and renewal

Prices and VAT. Prices are in euro. Lottevo applies the VAT exemption for small enterprises (article 310 of the Romanian Fiscal Code), so no VAT is added to our prices. Businesses established elsewhere in the EU account for VAT themselves under the reverse-charge mechanism and must give a VAT number confirmed by the European Commission's VIES service; a number VIES does not recognise cannot be saved. Each invoice states the VAT treatment applied.

Paying. Payments are processed by Stripe. Card and SEPA Direct Debit payments are charged at the start of each billing period. If you choose bank transfer, you receive a proforma for each period and pay it within 14 days into the bank account shown on it; the fiscal invoice is issued once the payment arrives, and a new plan starts when the first payment arrives.

Automatic renewal. A paid plan is a subscription. It renews automatically at the end of each monthly or yearly period, for another period of the same length, until you cancel it. Each renewal is charged at the plan's price at that time.

Price changes. If we change the price of your plan, we will tell you at least 30 days before the new price applies to your next renewal. If you do not agree, you can cancel before that renewal.

Cancelling and changing plan. You can cancel or change your plan at any time from the billing portal in your workspace. Cancelling stops the next renewal; the plan stays active until the end of the period already paid. Before you confirm a change of plan, the billing portal shows when it takes effect and what you will be charged or credited.

Invoices. A fiscal invoice is issued for every payment and is available in your workspace. Invoices for customers in Romania are also submitted to the national e-Factura system.

Late payment. If a payment fails or an invoice stays unpaid, the payment may be retried and access may continue for a short time. If it remains unpaid, the paid plan ends and your API keys stop returning data until a plan is active again.

Refunds. Fees for a period that has already started are not refunded, except where these terms, the Withdrawal and refunds policy or mandatory law provide otherwise.

8. Consumers: right of withdrawal

If you are a consumer, the Withdrawal and refunds policy explains your right of withdrawal, when it ends and how to use it. It forms part of these terms.

9. Suspension and termination

You may stop using the Service at any time and ask us to close your account by writing to contact@lottevo.com. Closing an account does not cancel a subscription retroactively; cancel it from the billing portal first.

We may suspend or revoke API keys, or suspend or close an account, if you seriously or repeatedly break these terms, if your use puts the Service or other customers at risk, or if the law requires it. Where we reasonably can, we will warn you first and give you the chance to fix the problem.

When an account is closed, its API keys stop working. The licence in section 4 continues for the data you already received, as described there. Sections 4 (the restrictions and the database right), 5, 7 (amounts owed), 10, 12 and 13 continue to apply.

10. Liability

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for harm caused intentionally or through gross negligence, or the rights consumers have under mandatory law.

Within those limits, we are not liable to you or to any other person, whatever the cause, for the accuracy of the results or of any other data we supply; for delays, inaccuracies, errors, interruptions or omissions in supplying them; or for any direct, indirect, incidental, special or consequential loss arising from them or from the use of the Service, including lost profits or revenue, business interruption, loss of data and losses from decisions taken on the basis of data, even if we were told such loss was possible.

We are not liable for claims that third parties bring against you concerning the data or your use of it. Anyone to whom you make data available has no contractual relationship with us and acquires no rights under these terms: you answer to them, and these terms bind only you and us.

11. Personal data

How we process personal data is described in the Privacy Policy, and the cookies the website uses in the Cookie Policy.

12. Changes to these terms

We may update these terms. Each version carries a number and the date it takes effect. We will tell you about material changes by email or in your workspace at least 30 days before they take effect, and ask you to accept the new version. If you do not agree, you may cancel your plan and close your account before the change applies.

13. Governing law and disputes

These terms are governed by Romanian law. Disputes go to the competent courts at our registered office. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may also bring a dispute before the courts there or the competent consumer protection authority.

Consumers can also ask for alternative dispute resolution through the Romanian National Authority for Consumer Protection (ANPC), at reclamatiisal.anpc.ro.
